With the first child’s life saved a mother, her pregnant daughter and a driver woman friend apparently entered the mill before I arrived (0830 AM). Also the driver left before I got there. The driver returned a little after 9:30 AM when meter parking begins. I counseled her as she walked into the mill not knowing if she was alone or with someone in the mill. She ignored me. Sometime later the driver came out and I again tried to counsel her addressing either herself or someone she might be with that was abortion minded. She responded with “she is only 12 years old; she has to have an abortion.” I pleaded with her that the girl did not have to have an abortion. I offered help to keep the baby or to put the baby up for adoption. I explaining the dangers of abortion and the terrible thing they do to the baby to end its life and that the baby’s body parts end up in a sewer, landfill or for experimentation. She indicated that she really wasn’t for the abortion and agreed to take some literature to give to the girl and her mother saying it’s their choice but she would try to convince them not to have the abortion and give them the literature.
At this time I called 911 to report an underage girl in Planned Parenthood that was pregnant and obviously someone is abusing her and may be guilty of statutory rape. I was told they would send a patrol car. Planned Parenthood is required by law to report such incidents to the police. About 10:30 AM they all came out. I tried talking to the girl, the mother and the driver but they wouldn’t talk to me. They got in the car, left, and never returned. Pray that they let that baby live.
The police did not show up before they left. I called and canceled the 911 call. Second guessing that action maybe I should not have cancelled the 911 call but instead wait to see of the police would ever show. In past similar incidents they never showed up.
With the second child’s life saved an abortion minded 16 year old girl got out of a car with an adult couple (not her parents) leaving a male driver in the car. I counseled all three as they walked slowly towards the mill door. They told me the girl was there for an abortion. All three responded to my counseling with interest and agreement, smiling as I talked, especially the two adults. They entered the mill listening to my last pleadings as the door closed “Don’t let them take your child’s life! We can and will help you! Please let us help you!” I turned around and spotted the car still in front so I went to speak to the driver. I spoke with him a good twenty minutes explaining all the terrible things regarding abortion. He told me he didn’t really know why they were there and was concerned when I told him they do abortions on Wednesdays. He then agreed with everything I said. He said he was against abortion. I told him to go inside and talk them out of that girl having an abortion. I told him to leave the car (not legally parked) that I would pay the fine if he got a ticket. Instead he started to pull out to park elsewhere when the male adult came out and started talking to him. I started talking to the male adult about getting the girl out of mill. He made some agreeing statements. Then the girl and the female adult came out. It turned out they decided to not go through with the abortion. While the girl and the female adult got into the car I asked the male adult if I can give the girl a gift for her baby. He said yes that he would take the gift. I gave him a pair of baby bootees for the babies first gift. I God blessed the girl and all of them. A happy, joyful car full left the scene. Thanks be to God!

Police Incident
On Wednesday, Feb. 9, 2011, there was a police incident. A woman had come in with her abortion minded pregnant daughter. I counseled brief when they entered the mill. The mother protecting her daughter from hearing any help I had to offer. A couple of hours later after the deathscorts had left the mother came out and I proceeded to counsel her about the danger her daughter is in and other reasons whey her daughter should not have an abortion. She ignored me and didn’t want to hear anything I had to say. I followed her about 100 feet towards M Street. She stopped to smoke a cigarette. I continued to counsel her that if she loved her daughter she would not put her in harms way. She asked me to stop or she would call the police. I told her she could call the police but I want to make sure she understood the danger her daughter is in and the terrible thing they are going to do to her grandchild. I left her alone but not before she called the police about my ”harassing” her.
The police did come. One squad car with two police officers. I stood on the sidewalk by the mill entrance walkway paying no attention to the police. A man friend of the woman came out to talk with the police pointing to me, a couple of times, in his discussion. The man then entered the mill to get the woman to come out to talk to the police. When she came out I proceeded to counsel her about getting her daughter out of the mill if she loves her as she walked towards the two police officers. She then talked to the police for about 15 minutes. She then headed back into the mill while I again counseled her to get her daughter out of the mill is she loves her. The police were standing by silently. The police never spoke one word to me. After a few minutes they left. End of incident. The police supported my rights.
Apparently, as I had suspected, the police supported my right to talk with the woman even though she did not want to hear what I had to say.
This was similar to an incident a couple of years ago. I was counseling a woman right in front of the mill entrance door. She was annoyed at me and wanted me to stop. She asked the security guard isn’t there something that can be done to stop me like calling the police. The security guard told her there is nothing she could do. I have a right to do what I’m doing. If she doesn’t like it she can come back inside the mill or she can go for a walk and leave the area.

As the media hype begins to die down over the not-so-wonderful 50th anniversary of the birth control pill, Hollywood’s own Raquel Welch opines that she “laments the havoc that the free-sex ethos has wreaked on marriage and family life.”
In a CNN column entitled, appropriately, “It’s sex-o’clock in America,” she writes, One significant, and enduring, effect of the pill on female sexual attitudes during the ‘60s was: “Now we can have sex anytime we want, without the consequences. Hallelujah, let’s party!” It remains this way. These days, nobody seems able to “keep it in their pants” or honor a commitment! Raising the question: Is marriage still a viable option? I’m ashamed to admit that I myself have been married four times, and yet I still feel that it is the cornerstone of civilization, an essential institution that stabilizes society, provides a sanctuary for children and saves us from anarchy.
In stark contrast, a lack of sexual inhibitions, or as some call it, “sexual freedom,” has taken the caution and discernment out of choosing a sexual partner, which used to be the equivalent of choosing a life partner. Without a commitment, the trust and loyalty between couples of childbearing age is missing, and obviously leads to incidents of infidelity. No one seems immune.
You probably haven’t seen her interviewed about this startling, rather uncommon perspective but nonetheless, it is refreshing to witness at least some soul searching in one of the sectors of the cultural mix from which emanates so much depiction of sexual satisfaction as the only thing that matters.
On the other hand, as my good friend Chris Kahlenborn, M.D., pointed out, the American College of Obstetricians and Gynecologists, from which sprang the twisted attitudes that made the pill acceptable, continues to deceive and deny the truth. In its celebratory editorial on the pill, ACOG’s Vice President of Practice Activities Hal Lawrence, M.D., characterizes the birth control pill as perfectly safe. The article opines,
The pill remains one of the safest and most popular forms of contraception in the U.S. No other single medication has empowered American women and impacted their quality of life as has the pill. “The challenge ahead is to improve more widespread and consistent use of contraception in the U.S. to help reduce the number of unplanned and undesired pregnancies,” said Dr. Lawrence.
This is all it took for Kahlenborn to respond since he is among the few honest physicians who have studied the pill and its connections to such dreadful diseases as breast cancer. Kahlenborn immediately wrote the following letter to the editor entitled “The Pill After 50 Years: That Dirty Little Secret.” Perhaps ACOG will ignore it, but here it is:
Last week was the 50th anniversary of the Food and Drug Administration’s approval of the birth control pill in the United States. Newspapers and magazines around the country ran stories on this, mostly extolling the social and medical benefits of the pill. This theme was bolstered by a recent communiqué from the American College of Obstetricians and Gynecologists (ACOG), which noted: “The pill remains one of the safest and most popular forms of contraception in the U.S.” (Office of Communications, ACOG, May 6, 2010,)
I find it disturbing that after nearly 50 years, both the media and the medical establishment have failed to give a true airing to one of the pill’s most dangerous side effects, namely, that “dirty little secret.” What’s that? One need only check the Mayo Clinic Proceedings—the major medical publication of the Mayo Clinic—to find our little-known study, which showed that the pill increases the risk of premenopausal breast cancer substantially when taken at a young age (see Mayo Clinic Proceedings: October 3, 2006). In October 2006, we reviewed the medical literature and combined data in an analysis (referred to as a meta-analysis): We found that 21 out of 23 studies showed that using oral contraceptives prior to a woman’s first birth resulted in a 44 percent increased risk in premenopausal breast cancer. Our meta-analysis remains the most recent study in this area and updates the previously analysis (the Oxford analysis published in 1996), which relied on older data with older women (two-thirds of whom were over age 45); unfortunately, the Oxford study continues to be quoted by ACOG, textbooks, the National Cancer Institute, the American Cancer Society and most researchers and obstetricians, claiming that oral contraceptives carry little breast cancer risk especially 10 years after last use.
I continue to be amazed at the discordance between the medical literature and public/medical awareness. To my dismay, after our meta-analysis was published, the Mayo Clinic sent out a press release to all major media in the country. The response? ( ). The blank space between the parentheses is purposeful. Although our meta-analysis received scant internet coverage, almost no major media covered this study, which is shocking, given the fact that about 40,000 women in the U.S. get premenopausal breast cancer annually, oral contraceptives are an elective risk factor and our study is the most recent meta-analysis to date on the oral contraceptive-breast cancer link.
In addition to our meta-analysis, it’s important to note that the World Health Organization classified oral contraceptives as a Class I carcinogen in 2005—the most dangerous classification. Even more data has come forth recently in a paper by several researchers—one of whom is a major researcher of the National Cancer Institute—which not only cited our meta-analysis, but found that oral contraceptives increase the risk of triple-negative breast cancer in women under 40 by 320 percent (triple-negative breast cancers are extremely aggressive). (Cancer Epidemiology, Biomarkers & Prevention, April 2009.)
Few in the medical establishment or the public are aware of this data, or if they are, young women almost never hear about them. It’s been almost four years since the publication of our study in the Mayo Clinic Proceedings; I am beginning to think that our study has been effectively “buried.” Breast cancer and the pill—that dirty little secret? Some day perhaps someone in the media and/or medical establishment will dust a little dirt off those pink ribbons and let young women hear all the facts so they can finally make truly informed decisions.
Dr. Kahlenborn is the lead author of the Mayo Clinic Proceedings’ article cited above. He testified before the FDA in June 2000 regarding the link between oral contraceptives and breast cancer. His insights are notably absent from the current spate of publicity being given to the pill, but they are nonetheless among the most honest you are likely to see. (NEW YORK – C-FAM) Late last week we reported in our weekly Friday Fax that the Girl Scouts allowed the distribution of an explicit and dangerous sex guide – produced by the International Planned Parenthood Federation – in a Girl Scout panel for adolescent girls at the UN.
We have been inundated with responses from Girl Scout moms, Girl Scout leaders and others angered and confused that such a thing could happen.
Recall the sex guide tells teenage girls, “Many people think sex is just about vaginal or anal intercourse… But, there are lots of different ways to have sex and lots of different types of sex. There is no right or wrong way to have sex. Just have fun, explore and be yourself!”
The sex guide goes on to tell girls, “Some people have sex when they have been drinking alcohol or using drugs. This is your choice.”
The Girl Scouts have flatly denied that the sex guide was available at their UN conference. We stand by our story and based on new evidence we go further. The sex guide was distributed with the full knowledge and consent of the Girl Scouts-USA.
SPECIFIC RESPONSES TO GIRL SCOUT’S DENIAL
1. The Girl Scouts imply another group left the literature prior to their panel. Understand that the Girl Scout meeting was on opening day of the conference (March 1), which means the room was clean of all literature that morning.
There were four other meetings in that room that day prior to the Girl Scouts meeting. At 10 am the NAACP had a meeting about climate change. At noon the UN had an orientation meeting for NGOs attending the conference. At 2 pm CORAID had a meeting about counterterrorism and women.
Very clearly, none of these meetings were on adolescent topics, which was the target audience of the sex guide.
2. The Girl Scouts say we were not in the room. That is true. All non-Scout adults were thrown out prior the meeting; and no wonder given what was distributed there. However, even though our source was thrown out of the room, she stayed around and as the doors closed she went right in to see what was being distributed. It was there and then that she found the stack of dangerous sex brochures.
The source for our story and the woman who went into the room to monitor what the Girl Scouts were doing is mother of seven Sharon Slater who is also president of longtime UN pro-family group Family Watch International.
That the Girl Scouts would allow such a guide makes sense. The meeting was for adolescent girls. The brochure was made for adolescent girls and boys. In an awful way, the brochure was in context for the Girl Scout meeting.
More importantly, the Girl Scouts have a long time relationship with Planned Parenthood.
Here is Girl Scout CEO Kathy Cloninger from a 2004 interview on The Today Show: …we partner with many organizations. We have relationships with our church communities, with YWCAs, and with Planned Parenthood organizations across the country, to bring information-based sex education programs to girls.”
If the Girl Scouts do not approve of the sex guide that they made available at their conference, they should say so.
If they do not approve of the brochure and its message, they should say so.
The Girl Scouts have an obligation to their members, to the girls and their parents to disassociate themselves from this dangerous Planned Parenthood sex guide for teenagers.

PP has introduced another offensive website http://www.takecaredownthere.org that demeans teens. PP has used young girls - 14 and 15 - in sex related clinical trials.
Over four million babies have died in Planned Parenthood facilities. Planned Parenthood has located almost 80% of their abortion facilities in
black neighborhoods, and black women have 35% of the abortions in the US, even though blacks make up only 12% of the US population. So Planned Parenthood has killed over 1.3 million black babies.
Planned Parenthood is a very successful business, but it is a disaster for America. It contributes to the spread of debilitating diseases, has
killed more people than currently live in many of our states, and has done it all under the guise of a “charitable” organization, with 39
percent of its funding coming from our taxes.
South Dakota passed a law that requires abortionists to tell women the truth that an abortion will “terminate the life of a whole, separate, unique, living human being”. (See sonograms of preborn babies by clicking here, including a dancing fetus.) Planned Parenthood said the law was “unconstitutional” and refused to obey it until the state threatened their license and a District Judge said that part of the law is constitutional and they must obey it. PP is continuing legal action against the law.
Washington State fined PP-Spokane $700,000 for three years of alleged fraud. PP had over-billed Medicaid (in some cases as much as three times) for services like abortion and contraception. Auditors outlined five categories of abuse which include everything from unnecessary pregnancy tests to charging Medicaid with post-abortion drugs. California and Texas auditors have also said that PP over-billed Medicaid. This contradicts Planned Parenthood’s longstanding claim that “family planning” money doesn’t pay for abortion-related services. PP will be entrusted with more health care dollars in the Senate health care bill.
The PP Director at their College Station, TX facility has resigned and joined the local pro-life group after she saw an ultrasound of an abortion. She said that she was pressured to generate more abortion business, not pregnancy prevention, because abortion is PP’s money maker. PP filed a court order to keep her from releasing information about PP business and patients, but she has no intention of providing information about patients. The court said PP’s action has no merit.

Planned Parenthood, the billion dollar corporate abortion mill, has taken indecency to a whole new level and is using your taxpayer dollars to do so. The organization, which is responsible for the abortion deaths of tens of millions of people, was founded in 1916 by admitted white-supremacist Margaret Sanger, with the lofty goal of, as Sanger put it, eliminating “the ever increasing, unceasingly spawning class of human beings who never should have been born at all.” Lest there be any doubt as to whom, exactly, Sanger was referring to, she also wrote: “We do not want the word to go out that we (Planned Parenthood) want to exterminate the Negro population.”
Sorry, Maggie. Word’s out.
Although Planned Parenthood’s primary mission is detestable beyond words and remains unchanged still today, its secondary goal, if left in a vacuum, is not so sinister. That is, of course, to make lots and lots of money.
But here’s what is sinister. In order to make lots and lots of money, Planned Parenthood, just like any other “service provider,” needs lots and lots of customers, and the best way to get those customers is to promote the very behaviors which create them. Specifically, to manipulate kids – under the guise of so-called “comprehensive sex education” – to engage in promiscuous, casual sex as soon and as often as possible. It’s simple supply and demand. Planned Parenthood encourages the behaviors which create the demand and then dutifully offers its deadly supply.
To that end, Planned Parenthood has created a new promotional Web site that targets youth. It’s called “Take Care Down There”. To visit their website, click here. It features short, near pornographic “public service” video vignettes which, among other things, promote casual sex, immodesty, homosexuality and even group sex.
For example, in perfect keeping with its demonstrably racist, loosey-goosey sexual tradition, one of the Planned Parenthood videos depicts what appears to be a teenage African-American male relegated to performing oral sex – in public – on a white teenage male. Another white male (a creepy adult authority figure who seems just a little too interested) walks up and begins giving instructions. The white teenager then says, “I didn’t even spew.”
In another vignette, a teenage girl appears to drop her pants – again in public – exposing her privates in front of two other girls and the same African-American male. She then asks them, “Do you see anything down there?” referencing potential evidence of sexually transmitted disease. Of course, based on her cavalier sexual attitude and tart immodesty (or is that immodest tart?) the odds strongly favor the likelihood that she does, in fact, have something “down there.”
So why does Planned Parenthood’s latest vulgar foray into the corruption of America’s youth concern you? Simple – you’re paying for it. Consider the following information compiled by Liberty Counsel:
Planned Parenthood has been receiving federal funding under the Title X Family Planning Program, enacted in 1970 as Title X of the Public Health Services Act. Section 1008 of the Act, as amended, stipulates that “None of the funds appropriated under this title shall be used in programs where abortion is a method of family planning,” yet Planned Parenthood is nevertheless receiving funds under this federal program.
During the 2006-2007 fiscal year, Planned Parenthood received a total of $336.7 million from government grants and contracts (that’s your taxpayer dollars). In 2008, $300 million was given to family planning clinics, under the Title X program. These funds were used to service over five million people, a third of which received “care” from a Planned Parenthood clinic.
On October 27, 2007, a coalition of leaders from dozens of conservative groups, including Liberty Counsel, Concerned Women for America, Focus on the Family, the American Family Association and more, signed a joint letter calling for the defunding of Planned Parenthood, after revelations of the abortion giant’s alleged systematic violation of Kansas state law came to light. Senator David Vitter (R-LA) and Representative Mike Pence (R-IN) have both introduced legislation that would prevent Planned Parenthood and other abortion providers from receiving taxpayer dollars in the future.
While commenting on Planned Parenthood’s latest abuse of taxpayer dollars, Attorney Mathew Staver, founder and chairman of Liberty Counsel, stated, “Planned Parenthood has now given the federal government yet another reason to stop funding this racist, eugenic, and immoral organization.
“Why should hardworking Americans pay to support Planned Parenthood’s profiteering sex agenda, that encourages teenage sex on the one hand and then profits by aborting the consequences of such promiscuity on the other hand?
Planned Parenthood’s Web site is offensive and, frankly, shocks the conscience. It is insane that we allow our tax dollars to fund such an irresponsible and destructive organization. We must stop funding Planned Parenthood and we must stop now!”
True, indeed. Beyond its stated mission to cleanse the world of “human beings who never should have been born at all,” Planned Parenthood’s primary purpose is to promote promiscuity among youth in order to line its pockets, plain and simple. There’s a clear conflict of interest here. When kids engage in risky sexual behaviors, Planned Parenthood wins. Why else would it be promoting casual sex, homosexuality and group sex?
It’s like the tobacco industry showing kids how fun and exciting it is to smoke cigarettes, and then telling them, with a wink, “But always smoke safely.” We wouldn’t allow Joe Camel access to our kids on the taxpayer dime; neither should we give Margaret “The Reaper” Sanger and her Planned Parenthood brood such taxpayer-funded access.

In less than nine months he has overturned the Mexico City policy which means American tax dollars will be used to pay for foreign abortions. Most of those killed will be the children of my beautiful brothers and sisters in Africa. He has also been working tirelessly to force physicians to either kill “unwanted children” or refer their patients to other baby killers. He has worked to ensure that even more children are killed by removing the ban from embryonic stem cell experiments where children are used as lab rats—their little bodies cut up and sold to the highest bidder.
President Obama’s most recent effort is to push a health care bill that will mandate taxpayer funding of abortions. He has gone on record to deny this fact which leaves many Americans wondering if he has bothered to read the 1000 plus-page monster circulating Congress.
I can’t help wondering if he has any idea what an abortion looks like. Does he understand that little babies, many of them very close to being born are gruesomely killed by suffocation, decapitation or dismemberment?
Since 1973, when Roe vs. Wade was decided, abortion has killed more than 50 million of America’s children-17 million of them were black. Today, for every black baby born, another black baby is killed by abortion. The Alan Guttmacher Institute and the Center for Disease Control, (CDC), show that Planned Parenthood, the nation’s largest abortion chain, has planted its clinics —more than 75 percent—strategically in our urban and minority neighborhoods. I find Mr. Obama’s abortion push especially strange because the abortion industry purposefully targets black people. Planned Parenthood’s founder, Margaret Sanger, initiated the Negro Project in 1939 to ensure that black people like President Obama and me were killed off before being born. Every day Planned Parenthood manages to convince pregnant black girls, especially in urban areas to abort by making them believe their pitiful lives will be better if their unwanted, unloved, worthless black ghetto child dies. They are wrong! We come from a strong stock of people who survived slavery and Jim Crow. We don’t have to kill our children to have better lives! So, how can President Obama support an industry that goes to such great lengths to kill black children? Could it be that he owes favors to the abortion industry? Unfortunately, the answer is he was bought off during his campaign. He climbed onto his White House throne by stepping on the backs of aborted babies.
Abortion is wrong, Mr. Obama and it’s wrong to expect tax payers to fund the blatant killing of children. If we are truly the America that holds life, liberty and the pursuit of happiness so dear — then we must obliterate the scourge of abortion from our midst otherwise we are no better than the those who perpetrate the conflict in Darfur, Rwanda, or any other country where human beings are enslaved, butchered or denied their rights just because they are meeker or weaker.Mr. President—abortion is not healthcare. There is nothing healthy about a procedure that mentally, emotionally and physically scars women—and there is nothing healthy about a dead baby.

The folks in charge of the Kansas State Fair apparently think that the words “Abortion is Not Health Care” are too controversial for the average State Fair attendee.
The paternalistic attitude of those in charge of exhibitor booth space has manifested itself in some unethical decisions and devious actions, all in an attempt to “protect” the general public in Kansas from seeing five simple words “Abortion is Not Health Care” on the fairgrounds.
The Kansas Coalition for Life (KCFL), which has an annual prolife petition, has chosen the theme “Abortion is Not Health Care” this year, directed toward the U.S. Congress. As they have for the last five years, KCFL attempted to secure a fair booth only to be given the run-around year after year.
This year, when there were still about 25 spaces available, Mark S. Gietzen, Chairman of the KCFL, filled out an application, which was received by the Fair Board on August 11th. However, 2 weeks before commencement of the State Fair, KCFL was still being denied booth space.
Mark called Denny Stoecklein, General Manager of the fair, who answered Mark’s availability question with a standard “We do not operate on a first come first served basis. We select our exhibitors based on who has the most to offer the Kansas Fair-goer.”
Denny made that statement before he knew just how popular the KCFL petition is.
KCFL’s “Abortion is Not Health Care” booth has proven to be very popular among the general public. In early August at the Midwest Catholic Family Conference held at Century II in Wichita, KCFL’s booth was the most popular exhibit there, with people even standing in line, waiting their turn to sign. The same thing happened at the Sedgwick County TEA party later that month; KCFL’s booth had more visitors than all the other exhibitors combined!
However, Denny’s mind was made up. When Mark mentioned setting up shop outside the State Fair grounds on public property, Denny threatened, “We would call the police and have you arrested!”
Mark then contacted Tom Tunnell, President of the Kansas State Fair Board, who stated without hesitation that KCFL’s booth request is 225th in line and that KCFL will have to wait just like everyone else!
Tom’s statement is a direct contradiction to Denny’s earlier position that Fair vendors are chosen by their expected interest to the general public rather than on a first come first served basis. In addition to this obvious contradiction, it is also quite a stretch of the imagination to believe that KCFL was still 225th in line after five continuous years of attempts to secure booth space at the State Fair.
Furthermore, Mr. Tunnell’s assertion is especially troubling after discovering that another exhibitor, “Pre-Paid Legal Services, Inc.” had never before requested booth space at the Fair, and yet was granted space upon it’s first application in 2008. Due to unrelated circumstances, the vendor was not able to fill the spot that year. But again in 2009 Pre-Paid Legal Services, Inc. was granted booth space without ever having to wait in line.
Judging by the pedestrian traffic at the Pre-Paid Legal Services booth, they certainly did not generate even a fraction of the public interest that the KCFL booth generated, even though it was banned from the fairgrounds.
How KCFL secured real estate outside the Fair grounds without being arrested, as threatened by Denny Stoecklein, is a story within itself.
A few hours before the Fair was to begin, KCFL sent out a Press Release protesting the unfair treatment and the Fair Board’s lack of ability to handle the situation ethically and in accordance with their own rules . . . whatever they are!
At the end of the press release, Gietzen complained about his apparent total loss of First Amendment Rights, in light of Denny’s threat to have him arrested if he were to set up shop on public property outside the fairgrounds to collect petition signatures.
Within one hour, Hutchinson Police Chief, Dick Heitschmidt called Mr. Gietzen and offered space on public property outside the Fair Grounds, across the street from Gate 9. However, occupancy was conditional.
Arbitrary and seemingly discriminatory rules included: no table on which to sign the petitions, no signs to attract visitors, and no tent to protect the volunteers and petition forms from the rain!
Furthermore, in violation of the most basic First Amendment privileges, KCFL volunteers were instructed to remain inside the boundaries of an orange snow-fence bullpen, which was 39 feet from the sidewalk that leads pedestrians to Gate 9. Nevertheless, KCFL was very grateful to the Police Chief for his efforts, and took occupancy of the fenced-in area on day one of the Fair.
In spite of these strict and unjust conditions, KCFL managed to get thousands of signatures by calling out loudly to fair-goers, as they entered and exited Gate 9.
On September 13th, the third day of the fair, I visited the State Fair in hopes of finding information that would lead to the real reason why KCFL was barred from the fairgrounds.
I asked Police Chief Heitschmidt about First Amendment rights – specifically the forbiddance of signage, or a tent to protect volunteers from the sun and rain. He asserted that First Amendment rights are not being violated because KCFL is being allowed to exercise freedom of speech. As long as they stay within stated boundaries, he added, there would be no risk of arrest by the Kansas Highway Patrol, which has jurisdiction throughout the state, including the Kansas State Fairgrounds.
Interestingly, by comparison, the Sedgwick County Police Department had a much different interpretation of KCFL’s First Amendment Rights during the 5 years that they occupied public property outside of the Tiller late-term abortion facility in Wichita. The Sedgwick County interpretation allowed a table, signs, chairs, a tent/umbrella, etc.
When asked, “On what basis does the Reno County Police Department interpret the First Amendment differently than the Sedgwick County Police Department?” Officer Heitschmidt again asserted that no rights are being violated.
Pressed for an explanation as to why KCFL volunteers can not walk around on public property, Officer Heitschmidt deferred to State Fair rules which, he said, extend beyond the boundaries of the Fairgrounds. He made it perfectly clear that even though KCFL was not admitted onto the fairgrounds, they still must abide by obscure “State Fair Rules” that apparently trump First Amendment Rights on public property!
The Hutchinson News reported on Wednesday, September 16th that City Attorney, Carolyn Patterson, decided that KCFL could hand out material in a designated “safe place.” This spot, though, happens to be a full 39 feet away from the public sidewalk, and therefore, places undue restrictions on the free speech rights of the volunteers for KCFL.
Was it really necessary to place KCFL 39 feet away from the sidewalk in order to be “safe?”
How are they safer 39 feet away, than they would be 5 feet away?
On Sunday, September 13th, Denny Stoecklein stated in a face to face interview that KCFL was not granted booth space because of the 225 vendors ahead of KCFL. That is not the same answer he gave to Mr. Gietzen; that exhibitors are selected based on who has the most to offer the Kansas fair-goer. He also added that by the time KCFL’s application was received on August 11th, there were no vacancies, and no cancellations. This is a direct contradiction to Sue Stoecklein’s acknowledgment on August 11th that there were still 25 vacancies.
When challenged about the inconsistency of his answers, and when offered photos showing the many available booth spaces around the fairgrounds, Denny said that part of the unused space is purposely left open for what he called “green space.” As for empty space #93 in the Meadowlark building, he believes that the space was paid for, but just not occupied for some reason.
I requested proof of payment from vendor #93 and also a list of the 225 vendors waiting in line. Denny asserted that he doesn’t have the records immediately available and suggested that the request for those records be made in writing.
As of the printing of this Press Release, no records were produced. And KCFL volunteers remain in a bull-pen outside fairgrounds doing their best to collect signatures. Mark Gietzen estimates they are getting about 1/10th of the number of signatures they would be getting if they had space inside the fairgrounds.
